Complete with rockered tip and tail as well as slight camber underfoot, testers praised the Wailer 112RP as “a great all-round ski for pow and variable conditions,” Its playful nature stood out to skiers, who commented, “They’re so easy to turn and whip around,” and “Kept up at speed. “Using DPS’s new Pure3 carbon pre-preg construction, which minimizes weight and waste in the process, the new Wailer 112 got even higher marks than last year. DPS Ski Mounting Form

When you purchase skis and bindings on dpsskis.com you can select to have DPS mount your bindings on your skis for a service fee. We then ship your new skis mounted to you. You will then have to take your skis to a certified binding technician to adjust your DIN settings. If you add binding mounting services to your cart, you must complete the form set forth below and agree to the liability waiver and release (the “Waiver”). You must complete a separate Waiver for each ski and binding combination purchased.

Note: Before completing this Waiver, make sure that the appropriate skis and bindings are in your shopping cart and that you have selected the option to have DPS mount your bindings on your skis. We will follow-up with a phone call or email if we have any questions.

*Release Of Liability
I acknowledge that I am at least 18 years old and that I must read and accept the terms of this Waiver as indicated below as a requirement for requesting that DPS mount the bindings selected above on the skis selected above. I have carefully read, the terms of this Waiver and understand and agree to the terms of this Waiver. I understand and agree that this is a legally binding contract.

WARNING, ASSUMPTION OF RISK, LIABILITY RELEASE, INDEMNITY and HOLD HARMLESS AGREEMENT

WARNING: BINDING DIN SETTINGS MUST BE ADJUSTED BY A CERTIFIED SKI TECHNICIAN BEFORE USE. DPS DOES NOT SET YOUR BINDING’S DIN SETTINGS.

I authorize DPS Skis to perform such work that is necessary to properly mount, test and/or repair my skis, bindings and/or boots (the “Equipment”).

I understand and agree that participation in skiing, snowboarding and related activities is HAZARDOUS and is not without significant risks. Such hazards and risks cannot be avoided without destroying the unique character of such activities. I understand that the same elements that contribute to the unique character of such activities can cause loss or damage to the Equipment as well as injuries that can in some cases be permanent or even death. I understand that such injuries and even death are common and ordinary occurrences during these activities.

I elect to participate in such activities using the Equipment despite the inherent and unknown risks and the possibility of injuries and death described above. I accept and assume full responsibility for ALL RISKS associated with such activities, including injury and death associated with the use of the Equipment. My participation in such activities using any items of the Equipment is purely voluntary and I have not been coerced or forced into participating.

With respect to the Equipment, I understand that the ski-boot-binding system is designed to release the boot from the ski when certain forces on the system reach preset values, but that the binding MAY NOT NECESSARILY RELEASE OR RETAIN THE SKI at all times where release or retention may prevent injury, and that RELEASE OR RETENTION CANNOT NECESSARILY PREVENT ALL INJURIES OR DEATH. I understand and agree that: (A) lower settings on the bindings will increase releasability but also increase the risk of injury that may be caused by inadvertent release of the ski; (B) higher settings on the bindings will increase retention but also increase the risk of injury that may be caused by retention; and (C) injuries due to unwanted release or retention of the ski are inherent risks of skiing.

I understand and agree that certain risk of skiing and snowboarding may be reduced, but not entirely eliminated, by: (A) taking lessons; (B) following the “YOUR RESPONSIBILITY CODE” which is posted at most winter sport recreational areas, and (C) using reasonable care and common sense. I further understand that a leash or other runaway prevention system is required with all skis and snowboards at all times, including while riding lifts and while carrying snowboards on or near a slope, in order to reduce the risk of injury to others.

I understand and agree that I will be responsible for all injuries to others caused by the use of any item of the Equipment by me or any other person. I will be responsible for all damage to the property of others or injuries or death to others resulting from the use of any item of the Equipment by me or any other person.

To the fullest extent allowed by law, I, on behalf of myself, my spouse and other family members, my heirs, executors, representatives and estate, hereby agree to forever WAIVE, RELEASE, DISCHARGE AND PROMISE NOT TO SUE OR ASSERT CLAMS AGAINST DPS, and all manufacturers and distributors of any item of the Equipment, as well as their respective owners, agents, employees, affiliated companies and successors and assigns, from ANY AND ALL RESPONSIBILITY, LOSSES, CLAIMS, SUITS, CAUSES OF ACTION, DAMAGES, EXPENSES OR ANY OTHER LEGAL LIABILITY incurred by them or arising out of the use of any item of the Equipment by me or any other person, including without limitation, any damage to property of, injuries to, or death of any user of any item of the Equipment, whether resulting from such parties’ negligence or any other cause.

I hereby further agree that I WILL HOLD HARMLESS, DEFEND AND INDEMNIFY SUCH PARTIES if any claims, suits, causes of action or other legal action is pursued by any third parties against them for any injuries, damages or death related to the use of any item of the Equipment by me or any other person.

I accept the Equipment “AS IS” and with NO WARRANTIES, express or implied, beyond the applicable manufacturer's written limited warranty, if any.

This document is a LEGALLY BINDING CONTRACT which supersedes any other agreements by or between the parties, and which constitutes the FINAL AND ENTIRE AGREEMENT regarding this transaction and this equipment. This document is intended to provide a COMPREHENSIVE RELEASE OF ALL LIABILITY which is binding upon and for the benefit of all parties, their heirs, agents and assigns, but it is not intended to assert any claims or defenses that are prohibited by law. If any part of this agreement is held to be invalid or unenforceable the remainder shall be given full force and effect. The specific legal rights of the parties may vary among different states and provinces.

I agree that this document shall be governed by and construed in accordance with the laws of Colorado. I agree that any action or proceeding commenced under or with respect to this Agreement shall be brought only in the county or district courts of Boulder County, Colorado, and I irrevocably consent to the jurisdiction of such courts and waive any right to alter or change venue, including by removal. I WAIVE ALL MY RIGHTS TO TRIAL BY JURY OF ANY SUIT, CLAIM, CAUSE OF ACTION OR OTHER ACTION ARISING OUT OF OR RELATED TO THE USE OF ANY ITEM OF THE EQUIPMENT BY ME OR ANY OTHER PERSON.

I understand that if I am not buying boots, my bindings will be mounted to the sole length I provide and no safety settings will be adjusted. Adjusting the safety settings on AT & Alpine bindings requires the boots that will be used with the setup. If you are ordering an AT or Alpine setup without boots you must have this done by a certified professional before skiing on it.
